Terms of Service

These Terms of Service (“Terms”) govern your use of the TFS Aerial Solutions website (tfsaerial.com) and client portal. By registering for an account or using our services, you agree to these Terms.

1. Services

TFS Aerial Solutions provides drone-based aerial survey services for oil palm estates, including aerial mapping, canopy health assessment, 3D estate modelling, and survey reports (“Services”). Access to completed survey data is provided through our secure client portal.

2. Client Portal Access

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials. Do not share your login details. Notify us immediately at info@tfsaerial.com if you suspect unauthorised access.

Authorised Use

Your portal account and survey data are for your internal business use only. You may not:

• Share portal access with third parties outside your organisation without our written consent
• Redistribute or resell survey deliverables as a standalone product
• Use our data to train AI or machine learning models without explicit written consent

3. Survey Data & Deliverables

Ownership

Survey deliverables (aerial maps, spatial data files, reports, 3D models) produced from surveys of your estate are licensed to you for internal use. TFS retains copyright in the methodology, processing pipeline, and software used to produce them.

Data Accuracy

Our surveys are conducted with professional-grade equipment and CAAM-licensed operators. However:

• All surveys are subject to weather conditions, airspace restrictions, and site access
• Mapping precision (sub-30cm GSD) is achieved under standard conditions; adverse weather or obstructions may affect quality
• Canopy health assessment is based on RGB aerial imagery. It is a visual assessment, not a laboratory analysis. Agronomist consultation and ground-level soil/foliage sampling are recommended for definitive diagnosis of disease or nutrient deficiency.
• GPS coordinates are accurate to survey-grade standards but should be verified before use in legal boundary disputes

No Warranty for Decision Outcomes

TFS provides data and recommendations as a professional service. We do not guarantee specific agronomic outcomes, yield improvements, or business results from acting on survey data.

4. EUDR & MSPO Documentation

TFS survey deliverables (GPS boundary polygons, orthomosaic records, survey metadata) may be used as supporting documentation in EUDR due diligence submissions and MSPO audit trails. TFS does not certify EUDR or MSPO compliance — compliance obligations remain with the estate operator and their certifying body.

5. Payment Terms

• Invoices are due within 30 days of issue unless otherwise agreed in writing
• Late payments may incur a 1.5% monthly charge
• TFS reserves the right to suspend portal access for accounts with outstanding invoices over 60 days
• All prices are in Malaysian Ringgit (MYR) unless otherwise stated
• Applicable SST will be charged where required

6. Cancellation & Refunds

Survey Cancellation

• Cancellation more than 7 days before scheduled flight: no charge
• Cancellation 2–7 days before: 25% of survey fee applies (mobilisation preparation)
• Cancellation within 48 hours or no-show: 50% of survey fee applies
• Cancellation due to TFS equipment failure or weather (our decision): full refund or rescheduling at no charge

Report Disputes

If you believe a deliverable is materially deficient, notify us within 14 days of delivery. We will review and, where appropriate, re-survey or revise the deliverable at no additional cost.

7. Limitation of Liability

To the maximum extent permitted by Malaysian law, TFS’s total liability for any claim arising from our Services shall not exceed the fees paid for the specific survey in question. We are not liable for indirect, consequential, or loss-of-profit damages.

8. Privacy

Our collection and use of your personal data is governed by our Privacy Policy.

9. Governing Law

These Terms are governed by the laws of Malaysia. Disputes will be subject to the jurisdiction of the Malaysian courts.

10. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the portal after changes constitutes acceptance of the updated Terms.
